if it is still under new car warrenty then yes you call them and ask them to book it in and have them look at it. If they ask why you undid the latch say you needed to but some thing in the boot and need the seats down to do it, and you had no other means but to undo it.

Funny, my car went in for the exact same problem last week and yes it is a warranty job. No need to wait for your next service.

How can they stuff up?
What, it just doesn't want to let go of the latch?
I'd say its a warranty job.

if the centre lap sash on my rear seat is even slightly pulled, it locks the fold down button for the rear seats

Yep, aparently the seat clip and the belt are some how linked. You'll find that the seat has not returned into the clip properly from the last time it was down and has now jammed. Not completely safe according to the mechanic. Glad I've been driving with it like that for a couple of months!

Just take it in, mine was done under warranty today. Seat belt is in fact a seperate issue, but they tell me 9/10 its related to the clip.
